Pedro Leon Padron, 33, has been charged with misdemeanor disorderly conduct – offensive /abusive/noisy/obscene – and misdemeanor dangerous weapon – prohibited acts. He pleaded not guilty to both charges.

According to Austin Police Captain Todd Clennon, police received a call at about 10:15 a.m. on Thursday regarding a man pointing a gun at another man in the back yard of a residence in the 500 block of Fifth Avenue Northwest. Padron was arrested, though the “victim” in this case said he and Padron knew each other and that the firearm in question was actually a BB gun. He said he advised Padron not to brandish the gun outside, but Padron decided to go outside and point the gun at him.

He told police he was not in fear because he knew it was a BB gun; however, neighborhood residents were not aware it was not a real firearm and called police.
